In 2020, 25 states and Washington D.C. will raise their minimum wage. Additionally, effective December 31, 2019, New York State’s salary threshold for exempt executive and administrative employees will increase. Employers need to increase the salaries of eligible employees classified by that date to maintain these exemptions.

The New York salary basis threshold for the executive and administrative exemptions will increase as follows:

• Large employers (11+ EEs)
– $1,125.00 per week ($58,500 annually) (Unchanged from 2019)
• Small employers (10 or fewer EEs)
– $1,125.00 per week ($58,500 annually)
Nassau/Suffolk/Westchester (as of 12/31/19)
• $975.00 per week ($50,700 annually)
Rest of NYS (as of 12/31/19)
• $885.00 per week ($46,020 annually)
