New Jersey recently passed a law prohibiting employers from asking interviewees about their criminal history. The new regulation applies to most employers with 15 or more employees, and it forbids them from asking, in oral or written form, about an applicant’s history with the criminal justice system. The ban requires employers to remove the box commonly used in employment applications, which requests that applicants indicate any previous convictions. However, the rule only affects the initial application process, as it allows such inquiries after the first interview has taken place. New Jersey employers should be sure to review their application process accordingly.
