We recently won, on the behalf of a client in the real estate industry, the dismissal of two charges: one alleging discrimination on the basis of age, and another alleging discrimination on the basis of disability. In response to our Position Paper filed with the New York State Division of Human Rights (“the Division”), the charges were dismissed for lack of “probable cause.”
After his termination, Complainant, a 77 year old superintendent employed by the client, filed a discrimination claim with the New York State Division of Human Rights. We compiled evidence of four years of inadequate job performance, complete with documented tenant complaints. Moreover, we presented evidence establishing practical and financial factors motivating our client’s decision to terminate. The Division agreed with our findings and dismissed both of Complainant’s charges for lack of “probable cause.”
