In March 2013, the New York State Legislature passed a law which will increase the State’s minimum wage from $7.25 per hour to $9.00 per hour over the next three years:
$8.00 on December 31, 2013,
$8.75 on December 31, 2014,
$9.00 on December 31, 2015.
The minimum wage will not increase for employees who receive tips. For these employees, the minimum wage will remain at $4.90 per hour for resort hotel workers, $5 per hour for food service workers, $5.50 for car wash workers, and $5.65 per hour for other service employees.
Under New York’s current minimum wage law, if tipped employees do not receive the minimum wage between wages paid and tips received, then the employer is responsible to make up the difference. This amount will not change for tipped workers and will remain at $7.25 per hour.
